Conservatorships are legal proceedings to provide court supervision for people who do not have capacity to either resist undue influence, fraud, etc., and/or cannot take care of their food, clothing, or shelter even with the help of friends and relatives.

It is important to understand that a Conservatorship is taking away the civil rights of an individual and giving the decision-making power to someone else. Courts will only do this if certain laws have been complied with and expert testimony is provided. The individual who is subject to a conservatorship has rights to oppose appointment of a conservator. And, a conservator has a fiduciary duty to act in the highest and best interest of the individual subject to a conservatorship.

Types of Conservatorship

  • LPS Conservatorship (Can only be started by the Public Guardian).
  • Probate Conservatorship (Can be started by anyone)
